The United States regulates nicotine pouches federally as tobacco products, under the Food, Drug, and Cosmetic Act as amended by the Tobacco Control Act.

The federal minimum age of sale is 21 for every tobacco product, set by 21 U.S.C. § 387f(d)(5). Retail restrictions sit in 21 CFR part 1140.

A pouch may not be sold unless the Food and Drug Administration has authorised it in advance. In January 2025 the agency granted the first such orders to a set of ZYN products, having found the public-health standard met.

States and cities may set stricter rules than the federal floor, and several do. This entry states the federal position only.
