Germany has no nicotine-pouch statute. The products are nonetheless unsaleable, because German authorities treat them as food.

Nicotine taken through the mouth lining counts as consumption under EU food law, so a pouch is a foodstuff. Added nicotine is a novel food ingredient with no EU authorisation, so a food containing it may not be placed on the market at all.

The Bavarian State Office for Health and Food Safety tested 184 nicotine pouch samples between January 2020 and November 2025. It judged all 184 unsafe and not marketable.

Possession and personal use are not offences, and this ban comes from food law rather than tobacco law — so it is a different kind of prohibition from the Dutch or Belgian one.
